Our website, https://massif.network/ and all *.massif.network subdomains (henceforth referred to as “Platform”), provides a comprehensive service for location scouting and production organisation. Users and Partners can browse a wide range of locations, organise their production and offer their Work, through our Platform (collectively, the “Services”). The Work is provided by our Partners, which include production companies that are efficient in all creative, technical, and logistical aspects, facilitating a seamless production planning process. The Work listed on our Platform and provided by our Partners can in some cases be limited to location scouting but may also include, but not limited to, additional services, such as production and know-how (collectively referred to as “Work”).

The Platform acts as a middleman between our Partners, who provide technical, creative, and logistical services to companies or individuals (henceforth collectively referred to as “Users”), who seek to utilize the Services provided by us and Work provided by our Partners. The Platform is used to facilitate the listing of certain filming locations and Work provided by our Partners.

We’re not a party to the terms between Users and the Partners. The Partner is solely responsible for the Work he provides.

By using the Platform or Services, you agree to comply with and be legally bound by the terms and conditions of these Terms of Use (“Terms”), whether or not you become a registered user of the Services. These Terms govern your access to and use of the Platform and Services and constitute a binding legal agreement between you and Massif. Our Platform is not a recommendation or endorsement of any Partner or his products, locations, services, facilities, etc.

To use our Services, you may need to create an account. Please make sure all provided information is correct and up to date, or you might not be able to access our Platform and Services. You’re responsible for anything that happens with your account, therefore please keep your username and password secret.

If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Platform or Services.

We offer you the right to use our Platform, which enables our Users and Partners to publish, offer, and search for Work, provided by our Partners. While we try to ensure that our Users and Partners have great experiences using our Platform, we do not and cannot control the conduct of our Partners.

You acknowledge that Massif has the right, but is not obligated, to monitor and administer the use of the Platform and verify information provided by our Partners and Users.
For example, we may review, disable access to, remove, or edit content to:

1. 1. operate, secure and improve the Platform;
   2. ensure our Users’ and Partners’ compliance with these Terms;
   3. comply with applicable law, the order or requirement of a court, law enforcement or other administrative agency or governmental body;
   4. address content that we determine is harmful or in any way not in compliance with these Terms;
   5. take actions set out in these Terms; and
   6. maintain and enforce any quality or eligibility criteria, including by removing listings or other content that violate these Terms.

Users and Partners acknowledge and agree that Massif administers its rules and policies, such as these Terms. Decisions about whether and how to apply them to a certain situation are taken at Massif’s sole discretion.

Users and Partners agree to cooperate with and assist Massif in good faith, and to provide Massif with necessary information and take actions as may be reasonably requested by Massif with respect to any investigation undertaken by Massif regarding the use or abuse of the Platform.

1. Account Creation:

• Users and Partners must create an account to access and use our platform.
• Users and Partners are responsible for providing accurate and up-to-date information during the account creation process.

2. Proper Use:

• Users and Partners must use the platform solely for the purpose of location scouting, production planning, and related activities.
• Users and Partners must comply with all applicable laws and regulations while using our Platform.
• Users and Partners must not engage in any activity that may disrupt or interfere with the functioning of our Platform or its associated systems.
• Users and Partners must not attempt to gain unauthorized access to any part of our Platform or its users’ accounts.
• User and Partners warrant that they purchase and offer their Work in good faith and are responsible for any payments made between themselves.

3. Content and Communication:

• Users and Partners are responsible for the accuracy and legality of any content they post, upload, or transmit through the platform.
• Users and Partners must not post or transmit any content that is unlawful, harmful, threatening, abusive, obscene, defamatory, or infringing upon intellectual property rights.
• Users and Partners must not engage in any form of harassment, including but not limited to, stalking, bullying, or hate speech.
• Users and Partners must not share or disclose any confidential or sensitive information through the platform without proper authorization.

Upon using our Platform and Services, we refer the User to a Partner which we deem a suitable fit to the User’s request.

Users must describe their idea and project to the Partner and make an agreement with them about their desired Project, following a referral from us.

Users are obligated pay our Partners a fee for Work provided. The fee is decided mutually by the referred User and our Partner.

Partners provide Work to our Users, upon being referred to by us. The referred User and our Partner shall then make an agreement, detailing the project and their work relationship (referred to as “Project”).

After being referred to by us, the Partner charges the User for provided Work. The fee is decided by mutual agreement between the Partner and the User.

We charge a commission for each referred User, which our Partners are obligated to pay to us. The commission amount for each Project between a referred User and our Partner shall be 3% of the total amount paid for the Project, by the User.

Partners are responsible and liable for their own acts and omissions, this also applies to anyone Partners allow to participate in the provision of Work to referred Users.

Massif’s Platform is solely intended for persons who are 18 years of age or older. The use of the Platform and its Services by anyone under 18 is prohibited.

By accessing our Platform, you confirm and warrant that you are 18 or older.

1. Ownership:

• All intellectual property rights, unless otherwise stated, including copyrights, trademarks, and patents, related to our Platform and its content, belong to us.
• Users are granted a limited, non-exclusive, and non-transferable license to access and use our platform for the purpose of location scouting and production planning.

2. Content Ownership:

• Users and Partners retain ownership of the content they post, upload, or transmit through the platform.
• By sharing content on the Platform, our Users and Partners grant us a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and display the content for the purpose of operating and promoting the Platform.
• Users, Partners, and anyone else using our Platform is not allowed to monitor, copy, scrape/crawl, download, reproduce or otherwise use anything on our Platform for any commercial purpose without written permission from Massif or our Partners.

The following items are valid, to the extent applicable, to anyone using our Platform.

1. Unauthorized Access:

• You must not attempt to gain unauthorized access to any part of our Platform, including other users’ accounts, databases, or any sensitive information.

2. Misuse of Information:

• You must not use any information obtained from our Platform for illegal or malicious purposes, including but not limited to hacking, identity theft, or unauthorized dissemination of personal information.

3. Offensive or Inappropriate content:

• You must not post, upload, or transmit any content that is defamatory, obscene, offensive, or pornographic in nature. This includes materials that promote violence, discrimination, or any form of illegal or harmful activities.

4. Unauthorized Modifications or Disruptions:

• You must not modify, disrupt, or interfere with the functioning of our Platform, its associated systems, or any third-party services connected to our Platform. This includes introducing viruses, malware, or any other malicious code.
• You must not frame, mirror, or otherwise incorporate any part of the Website into any other website without our express written authorization.

5. Violation of Terms of Use:

• You must not violate any of the terms and conditions outlined in these Terms. This includes breaching any provision, guideline, or policy specified in the agreement.
• Massif reserves the right to suspend or terminate any account registered on the Platform if the account is deemed to have violated these Terms or any other terms set forth by Massif.
• Massif also reserves the right to terminate any listed content from our Platform, if it is found to violate these Terms in any capacity.

1. Your use of the Platform, Services and our Partner’s Work in any capacity is done at your own risk. We provide our platform and its content “as is” and “as available”. The Platform, Services, content, Work and any other information provided is provided without any warranties, expressed or implied, regarding its reliability, accuracy, completeness, or suitability.
2. Neither Massif or any other person or entity associated with Massif makes any representations or warranties about the accuracy or completeness of information or content available on or through our Platform or the content of any social media platform or third-party website linked to or integrated with our Platform. This does not affect any warranties which cannot be excluded or limited under applicable law.
3. You acknowledge that Massif and our Platform are not liable for any delays, failure to perform or direct, indirect, incidental, consequential, or exemplary damages arising from the use or inability to use our Platform or our Services. This also applies to other damages, including but not limited to, punitive damages, personal injury, pain and suffering, emotional distress, loss of profits or revenue, loss of business or anticipated savings, loss of use, loss of goodwill or loss of any data. You also acknowledge that Massif is no way liable for any negligence or action shown or performed by our Partners, which results in the aforementioned consequences.
4. Massif is in no way responsible for any interruption of transmission to or from our Platform; any bugs, viruses, trojan horses, or the like that may be transmitted on or through our Platform; or any damages, losses, costs, expenses, or liabilities of any kind incurred as a result of any content posted or shared through our Platform.
5. We can’t guarantee, and are not liable for, that every piece of information regarding each location is completely accurate. However, when providing our Services, we take reasonable care and act with professional diligence. Unless we fail to do so, or have been negligent, we can’t be held responsible for any damages, interruptions, errors, or lack of information. However, it remains our priority to correct them as soon as we become aware of them.
6. You acknowledge that we are not responsible for any items listed in section 9.3 that may occur on your travels, stay or work at any of the locations listed on our Platform. You are required to do your own research into the circumstances at any given location, including but not limited to, the weather and any other natural and non-natural aspects. We are not liable for the provision of any information with regarding any natural event that may occur at any given location listed on our Platform.
7. We are not responsible for the payment of any duties or the acquisition of any filming or travelling permit, from any governing body or private individual/entity. Furthermore, we are not in any way responsible for providing or planning any logistical services related to the use of Services our Platform provides.

We are not responsible for managing your payment or ensuring the completion of your transaction with our Partner. Payments are made directly to our Partners, based on an agreement made between our Users and Partners. This applies to Work provided by our Partners that is listed on and purchased through our Platform.

We are not responsible for the management of payments for any services, provided by our Partners, regardless of whether they are directed through our Platform or not.

We bear no responsibility in connection with agreements made between our Users and our Partners.

We reserve the right to modify, suspend, or discontinue any part of our Platform or its Services at any time without prior notice. By using our Platform, you accept these Terms.
